Entries for this competition are open to participants from Sarawak, Sabah, West Malaysia and Brunei.

REGULATIONS

In consideration of the Organizer accepting an application by the Driver whose name appears below for entry to an Event or the Championship, the Driver acknowledges, represents and undertakes to the Promoter and the Organizer as follows :

(Regulations) – The Driver’s participation in the Championship or an Event is subject to the Driver complying with the regulations. The Driver has read the Regulations and will not breach any provision of the Regulations;

(Standard) – Having regard to the Event and the Power Boat will attain in a Race, the Driver has the necessary skills to participate in an Event and Championship and boat used by him or her will be suitable and seaworthy for each Race;
3 (Risk) – The Driver acknowledges that the Power Boat racing is a dangerous sport and the Driver has voluntarily assumed all risks associated with participation in each Event including the risk of loss to himself/herself or to other person;
4 (No Liability) – The Driver agrees that each Indemnified Person shall have no liability to him or her in contract, tort or otherwise including for negligence arising by reason of or in connection with the entry participation or failure to participate of him or her in an Event or Championship. This paragraph does not apply to liability with respect to death or personal injury;
5 (Death or person injury) – The Driver agrees that each Indemnified Person shall have no liability to him or her (but only to the extent permitted by law) for any death or personal injury arising by reason of or in connection with the entry, participation or failure to participate by him or her an Event or the Championship;
6 (Indemnity) – The Driver indemnifies each Indemnified Person and will keep each of them indemnified against all loss arising in any way out of him or her entry, participation or failure to participate in an Event or the Championship;
7 (Sums) – The Driver will pay all entry fees requested in any entry form for an Event or Championship and will pay as liquidated damages for breach of the Regulations any sum (including any fine or penalty) awarded against him or her in accordance with the Regulations;
8 (Consents) – The Driver grants to the Promoter and the Organizer all consents and approvals and makes all assignments required by the Regulations;
9 (Terms) – Terms defined in the Regulations shall apply in this declaration unless the context requires otherwise Indemnified Person means Promoter, the Organizer, State Government of Sarawak, each Manufacturer, other Driver and each of their respective employees, agents, officials and contractors. Loss included liability, cost damage, expense fee or charge in respect of any property or person and death or injury to any person;
10 (Severance) – Should any term or condition in this declaration be prohibited or unenforceable in any jurisdiction, that term or condition will be ineffective as to that jurisdiction to the extent of the prohibition or unenforceability. That shall not affect the validity or enforceability of that term or condition in any other jurisdiction or the validity or enforceability of any other term or condition;
11 (Law) – The Regulations and this declaration are governed by the Laws of East Malaysia. The Driver submits to the non-exclusive jurisdiction of the East Malaysia Courts.
